Please read these Terms of Service ("Terms") carefully before using BingeReader (the "Service"), operated by BingeReader ("we," "us," or "our"). By creating an account, signing in (including via a third-party provider such as Google), or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
BingeReader is a managed platform that unifies a reader's ebook, audiobook, and comic library across sources (uploads, Calibre imports, and other supported sources), provisions each account its own isolated reading environment, and provides a web reader, annotation hub, Kobo/KOReader device sync, Send-to-Kindle delivery, and an OPDS catalog.
Pilot notice: The Service is currently offered as an open pilot. It is free of charge, and we are not processing payments at this time. Features, availability, and these Terms may change as the Service moves toward general availability. We may modify, suspend, or discontinue any part of the Service, or the pilot itself, at any time, with reasonable notice where practical.
2. Eligibility and Account Registration
- You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to create an account.
- You may register using an email address and password, a magic link, or a supported third-party sign-in (e.g., "Sign in with Google"). If you use a third-party sign-in, you authorize us to receive basic profile information (such as name and email) from that provider as described in our Privacy Policy.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at hello@bingereader.app of any unauthorized use.
- You must provide accurate account information and keep it up to date.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
1. Upload, import, or distribute content you do not have the legal right to possess or use, including pirated or unlawfully obtained book files.
2. Use the Service to circumvent, strip, or bypass Digital Rights Management (DRM) protections on any content.
3. Use the Service to facilitate copyright infringement, including sourcing, downloading, or obtaining books on behalf of yourself or others through unauthorized means.
4. Attempt to gain unauthorized access to another user's account, library, or isolated reading environment, or to the Service's infrastructure.
5. Use the Service to store or transmit malware, or to interfere with or disrupt the integrity or performance of the Service (including other tenants' provisioned environments).
6. Use automated means to scrape, bulk-extract, or abuse the Service, its APIs, or its OPDS catalog beyond your own library's normal use.
7. Misrepresent your identity, impersonate any person or entity, or misuse a third-party sign-in / OAuth connection beyond its intended authentication or integration purpose.
8. Resell, sublicense, or provide access to your account or your provisioned environment to unauthorized third parties.
We reserve the right to suspend or terminate accounts that violate this section.
4. Your Content and License
- Ownership: You retain all ownership rights to the book files, metadata, highlights, notes, and other content you upload or create in the Service ("Your Content"). We claim no ownership over Your Content.
- License to us: You grant BingeReader a limited, non-exclusive, worldwide license to host, store, process, reproduce, and transmit Your Content solely as necessary to provide the Service to you (e.g., syncing your books and highlights across your devices, generating covers/metadata, or delivering a book to your Kindle email at your request).
- Your responsibility: You represent that you have the legal right to upload and use Your Content on the Service (for example, that you own or are legally licensed to use each book file). We do not review Your Content for legality before it is stored, and we are not responsible for verifying your rights to it.
- Data portability: We are committed to ensuring your data is genuinely yours. Per-book original-file download is available today. Full-library export tooling (all files, metadata, and annotations in one package) is planned; until it ships, you may request an export of your data via hello@bingereader.app.
5. Third-Party Sign-In, Integrations, and Connected Services
- The Service may allow you to authenticate using a third-party identity provider (e.g., "Sign in with Google") or, in later releases, to connect third-party services (such as cloud storage for automated ingestion, or reading trackers like Hardcover, StoryGraph, Goodreads, or Readwise).
- Your use of any third-party provider is governed by that provider's own terms and privacy policy, in addition to these Terms.
- We are not responsible for the availability, accuracy, or conduct of third-party providers, or for any changes they make to their APIs or policies that affect functionality (for example, sync reliability of a connected reading tracker).
- You may disconnect a third-party integration at any time in account settings, and separately revoke BingeReader's access from that provider's own account security settings.
- BingeReader does not collect or store your Kobo account credentials; Kobo device sync is performed via a platform-issued sync endpoint that does not require your Kobo login.
6. Pilot Availability, Quotas, and Changes
- The Service is provided on a pilot, "as available" basis. We do not guarantee uninterrupted or error-free operation during this phase.
- Your account may be subject to storage quotas. We will make reasonable efforts to communicate quota limits and warn you before you exceed them.
- Backups during the pilot are limited; do not treat the Service as your sole copy of irreplaceable content. Keep your own backups of original files where practical.
- We may introduce, modify, or remove features, and may introduce paid plans in the future. If we do, we will provide advance notice before any charge is introduced to your account, and continued free access will not be silently converted to a paid plan without your affirmative consent.
7. Intellectual Property
The Service itself — including its software, design, branding, and underlying technology — is owned by BingeReader or its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any right to use BingeReader's trademarks, logos, or branding without prior written consent.
8. Termination
- You may stop using the Service and delete your account at any time via account settings or by contacting hello@bingereader.app.
- We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or if required by law, and, where practical, will provide notice before doing so.
- Upon termination, your right to use the Service ceases. Sections of these Terms that by their nature should survive termination (e.g., ownership, disclaimers, limitation of liability) will survive.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," ESPECIALLY DURING THIS PILOT PHASE, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE DELIVERY, SYNC, OR STORAGE OUTCOMES FOR THIRD-PARTY DEVICES OR SERVICES (E.G., KOBO, KOREADER, KINDLE EMAIL DELIVERY, OR CONNECTED THIRD-PARTY TRACKERS), AS THESE DEPEND IN PART ON SYSTEMS WE DO NOT CONTROL.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BINGEREADER AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE SERVICE IS CURRENTLY FREE AND WE PROCESS NO PAYMENT FROM YOU, OUR AGGREGATE MONETARY LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SERVICE DURING THIS FREE PILOT PERIOD IS $0 (ZERO), TO THE EXTENT PERMITTED BY APPLICABLE LAW. IF WE INTRODUCE PAID PLANS IN THE FUTURE, THIS SECTION WILL BE UPDATED TO REFLECT AN APPROPRIATE LIABILITY CAP TIED TO AMOUNTS YOU HAVE PAID, AND YOU WILL BE NOTIFIED OF THAT CHANGE BEFORE IT TAKES EFFECT.
Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., for gross negligence, willful misconduct, or death/personal injury caused by our negligence, where applicable).
11. Indemnification
You agree to indemnify and hold BingeReader harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or Your Content, including any claim that Your Content infringes a third party's rights.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service will be resolved in the state or federal courts located in California, United States, unless applicable law requires otherwise.
13. Changes to These Terms
Because BingeReader is in active pilot development, we may update these Terms as the Service evolves (for example, when payments or new integrations launch). We will update the "Last updated" date and provide notice of material changes via email or an in-product notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
